HipHopGamz Terms & Conditions

1. Introduction

Welcome to HipHopGamz ("we," "us," "our"). These Terms & Conditions ("Terms") govern your access to and use of the HipHopGamz.com website, its subdomains (including recall.hiphopgamz.com, hiphopzcube.hiphopgamz.com, breaker.hiphopgamz.com, and breakoidz.hiphopgamz.com), and all related games, content, features, and services offered by us (collectively, the "Service").

The Service does not currently offer or require user accounts or registration. If account-based features are introduced in the future, additional terms may apply and will be presented at that time.

4. Intellectual Property Rights

The Service and all its original content, features, functionality, software, text, images, graphics, logos, icons, audio clips, video clips, data compilations, and the arrangement thereof are the exclusive property of HipHopGamz, its affiliates, partners, or licensors, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The HipHopGamz name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of HipHopGamz or its affiliates or licensors. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this Service are the trademarks of their respective owners.

Specifically, the "Hip Hop Heads" artwork featured in certain games is the property of André LeRoy Davis and is used under license.

5. Prohibited Conduct

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Engage in any conduct that is fraudulent, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.

7. Advertising and Sponsorship

The Service may be supported by advertising and sponsorship revenue and may display advertisements, sponsored campaigns, and promotions, including through third-party networks such as Google AdSense, subject to our Privacy Policy and your consent choices. The manner, mode, and extent of advertising on the Service are subject to change. HIPHOPGAMZ DOES NOT WARRANT THAT:

  • THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION;
  • ANY ERRORS OR DEFECTS WILL BE CORRECTED;
  • THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR
  • THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HIPHOPGAMZ, ITS AFFILIATES, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE OR ANY CONTENT ON THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT HIPHOPGAMZ HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL HIPHOPGAMZ'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF YOUR CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless HipHopGamz, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service.
